SAMIRAH v. O'CONNELL, 03-1786

A district court order reinstating an alien's advance parole, outside the context of a habeas proceeding, exceeded that court's jurisdiction, because the Attorney General's decision to grant or revoke parole is within the ambit of 8 U.S.C. section 1252(a)(2)(B)(ii).
