ALEXANDER v. DEANGELO, 02-3124
Use of trickery in a sting operation cannot in itself give rise to a 42 U.S.C. section 1983 suit for damages, but where a police officer may have induced an informant to engage in sex with a suspect, the elements of a battery committed by fraud are present. Nevertheless, officers are entitled to qualified immunity.
