United States Seventh Circuit

STORM v. STORM, 02-3078

A 28 U.S.C. section 1332 action alleging undue influence as to terms of a will and revocable trust was indistinguishable from a will contest under the probate exception, despite characterization as a tort action, so that no subject matter jurisdiction existed in district court.
