United States Seventh Circuit

THOMAS v. US, 02-3875

An argument, that an indictment was fatally defective where it did not specify drug quantity possessed with intent to distribute, is not a substantial one, thus the standards of 28 U.S.C. section 2253(c) have not been met and a certificate of appealability should not issue.
