GOMEZ-DIAZ v. ASHCROFT, 02-1446

Petitioner was a removable alien and did not automatically acquire U.S. citizenship when the Child Citizenship Act of 2000 took effect. The expanded definition of "aggravated felony" under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 applies retroactively.
