U.S.S.G. section 2J1.6(b)(2)(A) applies to enhance an offense level for defendant's role in a co-conspirator's failure to appear, where defendant was aware of the penalties his co-conspirator was facing, and defendant is not punished for co-conspirator's pre-conspiracy conduct.
