United States Seventh Circuit
CLARK v. CITY OF BRAIDWOOD, 01-4270
A 42 U.S.C. section 1983 complaint alleged that a city's action was a continuing trespass under Illinois law, and that plaintiff did not learn of the injury until some point outside of the limitations period, thus dismissal was premature.
