DERSCH ENERGIES, INC. v. SHELL OIL CO., 01-2495

Petroleum Marketing Practices Act section 2805(f)(1) does not provide franchisees with an implied private right of action for a franchisor's violation of its provisions, and defendant's alleged violations did not constitute a non-renewal of the parties' franchise relationship within the meaning of the Act.
