Because the petitioner has not exhausted his administrative remedies regarding his removal, his claims that he was eligible for relief from removal through either withholding of removal or by the application of the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) denied for lack of jurisdiction, even though there appear to be serious flaws in the INS's consideration of petition.
