United States Seventh Circuit

FYRNETICS (HONG KONG) LTD. v. QUANTUM GROUP, INC., 01-1318

In a claim based on the sale of defective products which resulted in a recall, evidence did not show that parties deviated from a license agreement (which contained an arbitration provision); one non-signatory was bound by the agreement as a successor-in-interest, and further findings were necessary as to the potential to bind another.
