US v. WHITLOW, 01-3999

Defendant's waiver of his appellate rights as part of a plea bargain, for which he received a large sentence reduction, and his failure to keep that promise, will act to block a number of his arguments on appeal, but defendant was nonetheless entitled to remand for resentencing where the less favorable of two U.S.S.G. Manuals in force at the time was used in his sentencing.
