United States Seventh Circuit

RYAN v. UNION PACIFIC R.R. CO., 01-3204

Because collective bargaining agreement between defendant employer and union appoints the latter as plaintiffs' exclusive representative in grievance proceedings, suit wherein plaintiffs sought representation by their own union should have been dismissed on merits rather than on jurisdictional grounds.
