United States Seventh Circuit
US v. THOMPSON, 99-4019, 99-4074, 99-4279
Consolidated appeals by three participants in drug conspiracy; all arguments rejected except challenge to district court's application of the drug offense murder cross reference to two defendants, which directs judges to apply the First-Degree Murder Guideline if defendant's relevant conduct includes the killing of a victim under circumstances that would constitute premeditated murder; court also approved admission of testimony of a murdered co-conspirator when the murder was reasonably foreseeable to other conspirators.
