United States Seventh Circuit

MITCHELL v. DONCHIN, 00-4196

Claimant never alleged that defendants took any step to prevent suit and should have been aware of the possibility of a claim against defendants, thus equitable estoppel and equitable tolling cannot apply to plaintiff's claims for First Amendment rights violations, which are barred by the two-year statute of limitations.
