MCCASKILL v. SCI MGMT. CORP., 00-2839

Because attorney's fee clause in arbitration agreement between plaintiff and her employer purports to prevent plaintiff from effectively vindicating her rights in the arbitral forum by preemptively denying her statutory right to attorney's fees authorized by Title VII, the arbitration agreement is unenforceable, and district court's order compelling arbitration reversed.
