United States Seventh Circuit

US v. THOMAS, 99-3459

Proof that defendant sold a distribution quantity of crack cocaine to buyer on one or more occasions, and inference that he was aware of buyer's conspiracy to distribute narcotics, did not establish defendant's membership in the conspiracy, where there was no evidence that he ever shared a stake in the success of the retail sales to his buyer's customers.
