United States Seventh Circuit

ROSS BROS. CONSTR. CO., INC. v. INT-L STEEL SERVS., INC., 01-1578

Invoices and mechanic's lien affidavit attached to the complaint evidenced that the plaintiff sought relief under three separate purchase orders, rather than one, and because the plaintiff made clear that it was seeking relief under three purchase orders during the summary judgment proceedings, district court's determination that two of three purchase orders were not at issue in the litigation was erroneous.
