United States Seventh Circuit
LESCH v. CROWN CORK & SEAL CO., 00-4239
Plaintiff's complaint, alleging that his employer violated the ADEA, 29 U.S.C. section 621, by dismissing him from his position and replacing him with someone younger, was properly dismissed because he failed to create a triable issue of fact on the critical question of pretext, given the fact that the younger employee had superior computer and accounting skills.
