United States Seventh Circuit
JOHNSON v. J.B. HUNT TRANSP., INC., 00-1268
Under worksharing agreement entered into between the EEOC and the Wisconsin Equal Rights Division (ERD), the ERDs waiver of exclusive jurisdiction over plaintiff's charge occurred at the time plaintiff's complaint was filed with the ERD, and waiver constituted a constructive termination of the state proceeding; thus, plaintiff's charge deemed timely filed with the EEOC and defendant's claims of error rejected.
