US v. MCGEE, 01-2554
In reviewing defendant's appeal of ruling on motion to suppress, court declined to adopt a rigid time formula regarding the amount of time officers must wait after announcing their presence prior to their forced entry into a premises, but did not find district court committed clear error in concluding defendant had exited his apartment when entry team first announced its presence and that any precipitous entry by the government in this case was harmless.
