US v. RIETZKE, 01-1802

Trial court's punishment of defendant under the felony provision of 18 U.S.C. section 924(a)(1)(D), for willful failure to maintain records contrary to sec. 922(b)(5), rather than under the misdemeanor provision of sec. 924(a)(3), which defendant contended was created for the purpose of treating licensed firearms dealers more leniently than other individuals, was not error.
