Where a defendant repeatedly refused to provide grand jury and trial testimony in violation of a cooperation agreement with the government and a court order, it is not an abuse of discretion to make an upward departure in sentencing him for contempt, in the amount necessary to take away the benefit originally conferred upon him as a result of his agreement to testify.
