The facts that a suit brought by the EEOC against an employer involved discrimination rather than harassment, sought compensatory and punitive damages rather than injunctive relief and back pay, and did not allege a company-wide pattern or practice of discrimination, did not alter the rule that suits brought by the EEOC on behalf of a class are not subject to Rule 23(f) of the Federal Rules of Civil Procedure.
