MERHEB v. ILLINOIS STATE TOLL HIGHWAY AUTH., 00-2547

An employer need not tolerate the continued presence of an employee who has terrified his coworkers merely because the technical elements of an assault are not present, and any workplace rule limiting the employer's action to a verbal reprimand in such a case would be absurd and void.
