HARRIS v. CITY OF CHICAGO, 00-2172

When a defendant refuses to answer any of plaintiff's discovery requests on the basis of the 5th Amendment and makes no attempt to amend those responses prior to testifying to the same matters at trial, the plaintiff has a right to refer to the earlier silence.
