United States Seventh Circuit

US v. MARTINEZ, 00-1967

Where the jury heard evidence of the duration and scope of an illegal drug operation, and numerous witnesses testified to seeing defendant with varying amounts of crack cocaine, including one witness who sold defendant more than 17 times the amount resulting in a life sentence, the overwhelming evidence of guilt cannot justify a reversal on the basis of Apprendi error.
