PIASKOWSKI v. BETT, 01-1159

Where one witness with suspect credibility places defendant at the scene of the crime, and another witness relays hearsay that "everybody" hit the victim, the conclusion that defendant conspired with the others to kill the victim in order to hide the crime of battery does not amount to proof of involvement in a murder conspiracy beyond a reasonable doubt.
