NICOSIA v. YELLOW FREIGHT SYS., INC., 99-3415

Where the employee must perform work on the employer's premises, and the job description specifically lists good attendance as a minimum job qualification, the ADA does not protect the employee whose disability prevents him from fulfilling the essential function of attendence.
