DYE v. WARGO, 00-3250

A municipality is not vicariously liable under 42 USC 1983 for constitutional torts of its employees, but answerable only for the consequences of its policies, and where municpality drafted the release, plaintiff cannot show that it was unenforceable simply because he was the only party to sign it.
