Deciding how many counts are needed for an effective case is a managerial decision committed to the discretion of the prosecution, and even if court severance of counts from the indictment reduces the number of counts or the number of defendants, it is not the equivalent of a ruling granting a motion in limine to exclude specified evidence from the trial.
