United States Seventh Circuit

YOUNGS v. OLD BEN COAL CO., 00-2190

Under Indiana law, an oil and gas lessor retains the rights to the use of the surface of the land without interfering with the lessee's operations, so an express right-to-remove clause does not give a lessor the right to remove a lessee's oil wells from its property.
