BETTS v. LITSCHER, 00-3072

Unless the court is satisfied that a defendant who is constitutionally entitled to the assistance of counsel on direct appeal would be making a frivolous appeal, it must instruct counsel to continue representing the appellant or appoint a new lawyer.
