United States Seventh Circuit
US v. CENTRACCHIO, 00-3963
Filing a notice of appeal does not automatically divest the trial court of jurisdiction over the case, and 18 USC 3731(2) requires the government to file the notice of appeal before jeopardy attaches to the defendant, i.e., before the jury is sworn.
