United States Sixth Circuit
Younis v. Pinnacle Airlines, Inc., 08-6112
In plaintiff's suit for employment discrimination and retaliation under Title VII, claiming that he was terminated from his position as a pilot with defendant airline company because he was an Arab-American and Muslim, district court's judgment in favor of the defendant is affirmed where: 1) plaintiff has not satisfied the requirement that an employee exhaust administrative remedies with regard to a claim of hostile work environment under Title VII before bringing suit on that claim in federal court; 2) plaintiff also failed to exhaust his administrative remedies on the retaliation claim; and 3) district court did not err in granting summary judgment on plaintiff's disparate treatment claim as he did not establish a Title VII violation circumstantially because he could not show that he was treated in all relevant respects less favorably than a similarly situated pilot with the defendant company at the rank of captain.
