Smith v. County of Lenawee, 09-1703

In an action brought by the estate of a deceased plaintiff, who died while in custody of the county sheriff's department, the order of the district court denying defendant-parole agent's motion for summary judgment on the gross negligence claim is reversed as, defendant's actions were not the proximate cause of plaintiff's death and defendant is thus entitled to governmental immunity.
