Lee v. Javitch, Block & Rathbone LLP, 08-4485
In plaintiff's suit against a law firm pursuant to the Fair Debt Collection Practices Act and the Ohio Consumer Sales Practices Act, claiming that the law firm filed an affidavit that was false in its application for a non-wage garnishment of plaintiff's bank account, the judgment of the district court is reversed and remanded, as plaintiff did not prove that defendant's affidavit was false because she did not establish at trial that reasonableness demanded any additional investigation of her bank accounts.
