US v. Mardis, 09-5696

In a federal indictment of a defendant for civil rights murder of an enforcement officer and related offenses, district court's denial of a motion to dismiss is affirmed where: 1) the facts of this case do not rise to the level of a "sham prosecution" so as to qualify for the exemption to the dual sovereignty doctrine; and 2) defendant's argument that the dual sovereignty doctrine is against public policy is rejected.
