Wuliger v. Mfrs. Life Ins. Co., 08-3342
In an action for rescission of insurance policies based on their allegedly fraudulent procurement, summary judgment for Plaintiff is reversed, where a failure by the insured to disclose conditions affecting the risk, of which he is aware, makes the contract voidable at the insurer's option, and Defendant-Insurer did not exercise that option.
