Baden-Winterwood v. Life Time Fitness, Inc., 07-4437

In a the Fair Labor Standards Act (FLSA) action seeking unpaid overtime wages, summary judgment for Plaintiffs is affirmed in part, where Defendant made improper deductions from Plaintiffs' wages under 29 C.F.R. section 541.603, but reversed in part, where Defendant's pre-August 2004 compensation plan did not create a substantial likelihood of deductions.
