Moses v. Providence Hosp., 07-2111

In an Emergency Medical Treatment and Active Labor Act (EMTALA) action based on a hospital's allegedly negligent release of a patient, summary judgment for Defendants is affirmed in part, where EMTALA does not allow for private actions against individuals, but reversed in part, where non-patients may sue under EMTALA's civil enforcement provision.
