Tackett v. M&G Polymers, USA, LLC, 07-4515
In an ERISA and Labor Management Relations Act (LMRA) action for vested health-care benefits, the dismissal of the complaint is reversed, where: 1) a plaintiff need not show a violation of LMRA for jurisdiction to exist under that statute; and 2) the complaint adequately pleaded Defendant's intention to vest benefits.
