Hamilton v. Gen. Elec. Co., 08-5023

In a retaliation suit alleging that plaintiff was terminated from his employment for filing an age discrimination complaint, summary judgment for defendant is reversed and remanded where: 1) a document signed by plaintiff did not waive his right to pursue claims based on defendant's future statutory violations; 2) plaintiff sufficiently alleged a causal connection between his termination and his discrimination complaint; and 3) plaintiff met his burden of raising a genuine issue of material fact regarding defendant's motivation for terminating him.
