Egerer v. Woodland Realty, Inc., 08-1173

In a putative class action alleging that defendants violated the Real Estate Settlement and Procedures Act by paying and receiving unlawful referral fees for title insurance business, summary judgment for defendants is affirmed where: 1) one set of claims was barred by RESPA's applicable statute of limitations; and 2) another set of claims failed to state a cause of action under RESPA.
