Duncan v. US, 06-5021

Sentence for possession of a firearm by a felon is affirmed where the Supreme Court's decision in US v. Booker, 543 U.S. 220 (2005), does not apply retroactively on collateral review to sentences imposed before Booker but after the Court decided Blakely v. Washington, 542 U.S. 296 (2004).
