Langley v. Prudential Mortgage Capital Co., LLC, 08-5032
In a case involving two sizeable real estate loans by defendant-lender to plaintiff-borrower, a ruling finding that the contracts at issue were invalid and declining to enforce forum selection clauses is vacated and remanded for consideration of a motion to enforce the clauses where, for purposes of deciding the issue concerning the enforcement of the forum selection clauses, both Rate Lock Agreements constituted valid and enforceable contracts.
