United States Sixth Circuit
Davis v. Michigan Bell Tele. Co., 07-1512
In an FMLA action, summary judgment for defendant-employer is affirmed over claims that: 1) the district court erred in finding plaintiff ineligible for FMLA benefits because her eligibility from 2004 should have carried over into 2005; 2) defendant should be estopped from challenging her FMLA eligibility; and 3) she was entitled to recover because of defendant's failure to provide proper notice of ineligibility.
