United States Sixth Circuit

Ford v. County of Grand Traverse, 07-1062

In a civil rights suit against defendants-jail officials and county arising after plaintiff was arrested on a probation violation, taken to jail and subsequently sustained injuries from an epileptic seizure, a judgment pursuant to a jury verdict for plaintiff is affirmed where: 1) county's failure to renew its Rule 50(a) motion at the close of all the evidence is excused; 2) county waived its argument that the exoneration of individual jail officials barred a finding of municipal liability; 3) a reasonable jury could conclude that the county's policy regarding weekend medical care was the cause of her injuries; and 4) the county abandoned a claim that its policy did not constitute deliberate indifference to her serious medical needs.
