B&G Mining, Inc. v. Director, Office of Workers' Comp. Programs, 07-3162
In a black-lung benefits case in which the claimant received an award of benefits against his employer-mining company and its insurer, awards of attorney's fees for claimant's attorney made under fee-shifting provision of the Black Lung Benefits Act are affirmed where there was no abuse of discretion as to the rates selected by the adjudicators below, or as to the hours they approved.
