Hamilton v. Starcom Mediavest Group, Inc., 07-1208
In an action brought by former employee alleging defendants violated ERISA by terminating her employment in retaliation for exercising her right to claim disability benefits, summary judgment for defendants is affirmed where plaintiff failed to establish that defendants' proffered reason for firing her, the reorganization and hiring of candidates with greater experience, was mere pretext.
