Bishop v. Lucent Techs., Inc., 07-3435
An order dismissing retirees' claims for breach of fiduciary duty against their former employer and its employment benefit plan is affirmed where the incomplete allegations of the complaint, combined with plaintiffs' resolute and continued silence in the face of a motion to dismiss, did not justify any reasonable inference that plaintiffs' complaint was timely filed, and thus it was properly dismissed as time-barred.
